Kallmekg Visuals LLC (“Kallmekg Visuals,” “we,” “our,” or “us”) provides premium real estate photo and video production and related creative services. These Terms & Conditions (“Terms”) apply to every booking, project, and communication between Kallmekg Visuals and any individual or business (“Client,” “you,” or “your”) who hires us. By booking our services, you confirm you’ve read and agreed to these Terms.

 

1. Accepting These Terms

When you book a shoot, submit payment, sign an intake form, or hire us in any way, you agree to these Terms. These Terms are a legally binding agreement. They override any previous verbal or informal conversations. Any changes to these Terms must be made in writing and agreed to by both parties.

 

2. What We Do

Kallmekg Visuals provides real estate & commercial photo and video production services, including cinematic listing videos, professional photography, drone aerial footage and photography, twilight photography and videography, lifestyle content, retainer-based content production, and other creative services. The specific deliverables and pricing for your project are defined at the time of booking.

 

3. Booking & Payment

3.1 Individual Bookings

To reserve your shoot date and time, a non-refundable booking retainer of 50% of the total shoot cost is required to confirm your appointment. Your retainer secures your spot on our calendar and removes that time from availability for other clients. Because reserved time cannot be rebooked on short notice, retainers are non-refundable if the shoot is canceled or if the property is not ready upon our arrival. Your shoot date is not confirmed until we receive and confirm your payment.

3.2 Brokerage Billing

If you’re billed through an approved brokerage (such as Douglas Elliman, Corcoran, Compass, or similar), payment follows the brokerage’s agreed Net schedule (e.g., Net 15, Net 30, Net 45).

3.3 Late Payments

Invoices not paid by the due date will accrue interest at 1.5% per month (or the maximum legal rate, whichever is lower). We reserve the right to pause all ongoing and future work until outstanding balances are paid in full.

3.4 Chargebacks & Disputes

If you initiate a chargeback or payment dispute, you’re responsible for all associated fees, including bank fees, processing fees, and any legal costs we incur to recover the amount.

3.5 No Refunds

All payments are non-refundable once a shoot has been completed. This applies regardless of your satisfaction, a change of mind, or if the listing is withdrawn, sold, or transferred before we deliver the final photos or video.

 

4. Scope of Services

4.1 One (1) Location Per Booking

Each booking covers one (1) filming and photography location unless we’ve specifically agreed otherwise in writing before the shoot. Additional locations must be quoted separately.

4.2 Shoot Duration

On-site shoots typically run one (1) to eight (8) hours depending on the package you selected.

4.3 What’s Included

Services like drone footage, aerial photography, and twilight photography are included in packages where specified. Check your package details at booking.

4.4 What’s Not Included

Lifestyle content is not included in standard packages. This includes footage or photography of surrounding neighborhoods, downtown areas, amenities, restaurants, beaches, parks, or any location beyond the main property address, as well as any content featuring models or persons — including but not limited to models driving cars, swimming, riding horses, or engaging in any other lifestyle or activity-based scenarios. Lifestyle content is a separate, chargeable service.

4.5 Travel, Parking & Tolls

Pricing includes 30 miles of round-trip travel from our Cromwell, CT office. Travel beyond 30 miles is billed at $1.50 per mile (round trip), calculated using Google Maps. Listings more than 30 miles away may require a minimum package booking. Extended travel is reserved for full-service packages to ensure adequate time is allocated for each project. Our service area covers: Central Connecticut. Shoots outside this area may have additional travel fees, quoted in advance.

4.6 Weekend Shoots

Weekend shoots (Saturday or Sunday) include a $250 weekend fee, disclosed at booking. We do our best to accommodate your preferred time — please note that weekend slots are scheduled by location to ensure timely arrivals for all clients, so availability may be limited.

5. Everything Must Be in Writing

All scope, deliverables, add-ons, creative direction, revisions, and any changes to your booking must be confirmed in writing (email or text) to be valid. Verbal conversations, phone calls, voicemails, and assumptions don’t count.

Simple rule: if it’s not in writing, it’s not included. We’re not responsible for anything not explicitly agreed to in writing before the shoot.

 

6. Revisions

6.1 Free Minor Revision

Each delivered video or photo gallery includes one (1) free minor revision. A minor revision covers color adjustments, small text or graphic changes, and minor shot selection tweaks.

6.2 Revision Request Window

Revision requests must be submitted in writing within 5 calendar days of delivery. After 5 days, the project is considered accepted and closed.

6.3 Major Revisions

Major revisions — such as full re-edits, alternate versions, structural rebuilds, or significant creative changes to video or photo deliverables — are billed at $200/hour with a 1-hour minimum.

6.4 Change of Mind

If you or anyone else (the homeowner, your broker, a third party) simply changes their preference after delivery, that’s not our error. These requests are billed at the major revision rate. Music changes after delivery also fall under this policy.

6.5 Rush Delivery

Rush delivery (2–3 business days, where available) costs an extra $250. It must be requested and confirmed in writing at the time of booking.

 

7. Delivery

7.1 Turnaround Time

We aim to deliver premium photos and video within 5 business days of the shoot. Depending on volume, high season, or project scope, it may take up to 10 business days. Delivery timelines are estimates, not guarantees.

7.2 How Files Are Delivered

Photo and video files are delivered via our cloud-based platform or Dropbox.

7.3 Acceptance Window

You have 5 calendar days after delivery to flag any issues or request a revision. If we don’t hear from you within 5 days, the delivery is considered accepted and final.

7.4 File Storage

Please download your files within 60 calendar days of delivery. After 60 days, we may remove files from our cloud storage. Re-delivery after this period may come with an archive retrieval fee, or may not be possible if files have been permanently deleted. It is your responsibility to promptly download and securely store all delivered photo and video files to your own storage systems. Kallmekg Visuals will archive final delivered files for 6 months from the date of delivery. During this period, files may be re-delivered upon written request, subject to availability. We are not obligated to retain files beyond this period, and we make no guarantees regarding the availability or recoverability of files after the archival period expires.

 

8. Property Preparation

8.1 Be Ready When We Arrive

The property must be fully cleaned, staged, and shoot-ready when we arrive. All lights (interior and exterior) must be on. Pets must be removed. Foot traffic should be minimized during filming and photography.

8.2 Our Responsibility

We don’t clean, organize, stage, or prep the property in any way. That’s the responsibility of the Client, listing agent, or homeowner.

8.3 If the Property Isn’t Ready

If the property isn’t shoot-ready when we arrive, a wait fee of $200/hour applies. If it can’t be made ready in a reasonable time, the Client is responsible for rescheduling at full cost (see Section 9).

8.4 Exclusive Access Required

We need exclusive access to the property during our shoot. Other photographers, videographers, inspectors, contractors, or vendors cannot be on-site during our scheduled window. If they are, we may (a) wait and bill $200/hour for wait time, or (b) reschedule with a $250 call-out fee plus any rescheduling fees. Please coordinate all vendor schedules accordingly.

8.5 Photographer & Videographer Discretion

We will make reasonable efforts to capture all significant areas of the property in both photo and video. Inclusion of specific areas such as garages, unfinished basements, or storage areas is at the photographer’s/videographer’s discretion unless requested in advance and confirmed in writing.

8.6 Post-Production Limitations

Kallmekg Visuals will not alter images or footage to conceal permanent property defects or structural elements, including cracks, utility lines, towers, neighboring structures, or other fixed features.

 

9. Cancellations & Rescheduling

9.1 All Bookings Are Final

When you book, you are reserving a specific date and time exclusively for your property. That time is removed from our calendar and cannot be offered to other clients on short notice.

9.2 All Retainers Are Non-Refundable

All retainers are non-refundable regardless of the reason for cancellation, including listing withdrawals, property sales prior to the shoot, or the property not being ready upon our arrival.

9.3 Cancellations With More Than 48 Hours’ Notice

Your retainer may be transferred one (1) time to a future appointment date, subject to our availability. If a refund is approved under any exception, credit card processing fees are non-refundable.

9.4 Cancellations Within 48 Hours of the Appointment

The retainer is forfeited in full. A new retainer will be required to book a new appointment.

9.5 Reschedules Within 48 Hours of the Appointment

A $100 rescheduling fee will be added to your invoice. Rescheduled appointments are subject to availability. Your retainer may be transferred one (1) time to a future appointment date.

9.6 Cancellation by Kallmekg Visuals

In the rare case we need to cancel due to illness, emergency, or equipment failure before arrival, we’ll reschedule at no additional cost, with priority booking on the next available date.

 

10. Weather & Reshoots

10.1 Weather Calls

All weather-related decisions (delays, reschedules, reshoots) are made by Kallmekg Visuals at our sole discretion to maintain our quality standards.

10.2 Conditions We Shoot In

Photography and videography may proceed in cloudy, partly cloudy, or light drizzle conditions (drone excluded). If you choose to proceed under those conditions, Kallmekg Visuals will produce the best results possible. Sky replacement is available for cloudy conditions.

10.3 Weather Reshoot Fee

If a shoot is rescheduled or reshot due to weather, a flat $250 fee applies. Weather is no one’s fault — this fee ensures the cost is shared fairly. Rescheduling due to weather is subject to our availability.

10.4 Client-Caused Reshoot Fee

If a reshoot is needed because of something on your end (lights off, property not staged, homeowner interference, pets present, access denied or delayed), a minimum reshoot fee of $500 applies.

10.5 Equipment Failure

If our equipment fails (camera, drone, etc.), we’ll reshoot the affected portions at our own expense. We’re not liable for delays or indirect damages caused by equipment failure.

 

11. Drone Services

11.1 FAA Compliance

All drone operations follow FAA regulations and applicable airspace authorizations. We operate under all required licenses and certifications.

11.2 No Guarantee in Restricted Areas

We can’t guarantee drone use in restricted or controlled airspace. If drone footage or aerial photography can’t be captured due to regulations, no refund or credit will be issued.

 

12. Music

12.1 Choose Music Before the Shoot

If you have a preferred track or style for your video, let us know in writing before the shoot. We may also offer options for you to approve in advance.

12.2 Music Is Final at Delivery

Music selections are locked in when the video is delivered. Any change after delivery is treated as a major revision and billed per Section 6.3.

 

13. Usage Rights & Licensing

13.1 Your License

Once payment is received in full, you’re granted a limited, non-exclusive, non-transferable license to use the delivered video(s) and photo(s) solely to market the specific listing the content was created for. This license extends to the booking agent and their brokerage.

13.2 Who Can’t Use the Content

Without our prior written permission and a separate licensing agreement, the videos and photos may NOT be shared with:

• Builders, developers, or construction companies

• Architects or interior designers

• Homeowners or property sellers

• Future listing agents (if the listing changes hands)

• Any third party not named in the original booking

13.3 License Doesn’t Transfer

If the listing changes hands for any reason, the license does not transfer to any new agent, brokerage, or party.

13.4 No Editing

The delivered videos and photos may not be edited, cut up, re-cut, combined with other footage, cropped for misrepresentation, or repurposed in any way by you or any third party.

13.5 Violations

Unauthorized use of our videos or photos is a breach of these Terms and a violation of our intellectual property rights. In the event of a violation, we may:

• Revoke all usage rights

• Issue takedown requests to MLS, Zillow, Realtor.com, social media platforms, and others

• Invoice a retroactive licensing fee of 10x the original shoot cost per unauthorized party

• Recover all legal fees and collection costs from you

 

14. Intellectual Property

14.1 Raw Files Are Ours

All raw footage, unedited photos, unedited media, project files, and source materials are and remain the sole property of Kallmekg Visuals LLC. You receive only the final delivered cut(s) and edited photo(s) specified in your booking.

14.2 Raw Files Not for Sale

Raw footage and unedited photos are not included in any package. If you’re interested, you can reach out in writing to inquire — pricing is at our discretion.

14.3 Copyright Stays With Us

Kallmekg Visuals retains full copyright and all intellectual property rights in every video and photo we produce. Your license under Section 13 is not a transfer of ownership.

14.4 Our Portfolio Rights

We retain the perpetual right to use any work produced under these Terms — including delivered videos, photos, behind-the-scenes content, and related media — in our portfolio, social media, marketing, and website, at no cost and without needing further permission.

 

15. Homeowner Permissions

By booking us, you confirm you’ve obtained all necessary permissions from the property owner(s) to allow us to enter, film, photograph, and produce content at the property. We’re not responsible for any disputes or claims from homeowners, neighbors, or other third parties related to the shoot.

 

16. Who Can Approve Changes

Only the booking agent or designated Client contact can approve changes, revisions, or scope modifications. Requests from assistants, transaction coordinators, brokers, homeowners, or other parties are not binding unless confirmed in writing by the original booking agent or Client.

17. Indemnification

You agree to defend and hold harmless Kallmekg Visuals LLC, its owners, employees, contractors, and agents from any claims, damages, losses, costs, or legal fees arising from: (a) your breach of these Terms; (b) your use, misuse, or unauthorized distribution of our videos or photos; (c) any dispute with the homeowner, brokerage, buyer, or other third party; or (d) any negligent or wrongful act by you or your agents.

 

18. Limitation of Liability

Our total liability to you will never exceed the amount you actually paid us for the specific shoot in question. We are not liable for any indirect, incidental, or consequential damages — including lost profits, lost sales, lost listings, or lost commissions — regardless of the circumstances.

 

19. Force Majeure

Neither party is liable for delays or failures caused by circumstances beyond their reasonable control — including natural disasters, severe weather, pandemics, government actions, or other force majeure events. If this happens, the affected party will notify the other in writing as soon as possible. Force majeure does not excuse any payment already owed to us.

 

20. Text Message Communications

By providing your phone number, you consent to receive recurring text messages from Kallmekg Visuals LLC about service updates, reminders, confirmations, and project notifications. Consent is not required to purchase our services.

We don’t sell or share your phone number with third parties for marketing purposes. You must be 18 or older (or have parental consent) to use our SMS service.

 

21. Privacy

Your privacy matters to us. Please review our Privacy Policy on our website for details on how your information is collected, used, and protected.

 

22. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes will be handled exclusively in the state or federal courts of Westchester County, New York, and both parties consent to jurisdiction there.

 

23. Entire Agreement

These Terms represent the full agreement between you and Kallmekg Visuals LLC. They replace all prior conversations, agreements, or understandings — written or verbal. Any changes must be in writing and signed by both parties.

 

24. Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in full effect.

 

25. No Waiver

If we don’t enforce a provision at a given time, that doesn’t mean we waive the right to enforce it later.

 

26. Updates to These Terms

We may update these Terms at any time. The “Last updated” date at the top will reflect any changes. Continuing to use our services after an update means you accept the revised Terms.
